Amid signs bank M&A may be picking up, institutions considering deals should fine-tune their communications strategies to secure approvals from regulators, these attorneys claim. They advise banks to contact regulators ahead of signing a merger agreement, to coordinate with regulators on prefiling meetings (and show up prepared for those meetings), and to provide regular updates on a deal's progress, among other suggestions.
It's no secret regulatory scrutiny of deals has intensified and approvals are taking longer, so also be sure to read summaries of the OCC's and FDIC's recent proposals to modify their M&A approval processes.
